Terms and Conditions

Please read these terms carefully before using our services.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR REQUESTING THE SERVICES MADE AVAILABLE TO YOU VIA MYTRIP'S APPLICATION(S) / WEBSITE(S), AS THEY INCLUDE IMPORTANT INFORMATION ABOUT THE SERVICES, YOUR RIGHTS AND OTHER IMPORTANT INFORMATION.

  • These Terms apply to MyTrip's mobile applications and websites.
  • The App(s)/Website(s) Services enable you to request services from MyTrip.
  • For MyTrip Provided Services, you are contracting directly with MyTrip for the provision of these services.
  • These Terms cover your use of MyTrip Transportation Services.
  • In order to provide MyTrip Transportation Services, we accept Bookings as a licensed private hire / taxi vehicle operator (under the relevant Indonesian operating licence) for the purposes of transportation legislation and regulation in Indonesia.
  • We keep these Terms updated and amend them from time to time. Please remember to check these Terms before you use the App(s)/Website(s) Services or MyTrip Products, as the latest set of Terms will apply in each case.

About Us

These Terms are entered into between you and MyTrip Global, a private limited liability company established in Indonesia, having its registered offices in Jakarta, registered under company number 121314.

Definitions

We have given certain words a defined meaning. These are set out below:

“App(s)/Website(s) Services” means the services provided to you by MyTrip, consisting of: (a) access to and use of MyTrip's mobile application(s) and/or website(s) which enable you to request and receive MyTrip Provided Services, MyTrip Insurance Services and/or Third Party Services; and/or (b) payment collection and payment processing services (including issuing invoices and receipts on behalf of Third Party Providers) allowing us to charge you and to pay charges into the bank account of MyTrip, MyTrip Affinity or Third Party Providers, as the case may be. MyTrip and/or MyTrip Affinity may engage affiliates or third parties to provide these payment collection and payment processing services on its behalf.

“Booking” means a booking of MyTrip Transportation Services.

“Community Guidelines” mean the guidelines, as updated from time to time, which set out expectations of all users of the App(s)/Website(s) Services.

“Insurer” means an insurer of a product provided by MyTrip Affinity to you, the details of which will be notified to you by MyTrip Affinity.

“Legislation” means the applicable Indonesian transportation laws and regulations governing taxi and private hire vehicle operators, together with any related national and local government regulations pertaining to the operation of PHVs.

“PHV” means private hire vehicle.

“Third Party Providers” are independent third parties and include, but are not limited to, independent transportation providers, travel providers, leisure providers, couriers, restaurants, logistics providers, and/or providers of other mobility services.

“Third Party Services” include, but are not limited to, services and goods in the field of transportation, travel, leisure, delivery, logistics, mobility, and the food or grocery industry, provided to you by independent Third Party Providers, made available through your use of the App(s)/Website(s) Services.

“MyTrip” means MyTrip, or any of its subsidiaries or affiliates (“we” or “us”).

“MyTrip Affinity” means MyTrip, a private limited liability company incorporated and registered in Indonesia.

“MyTrip Names, Marks or Works” means MyTrip or its licensor's company names, logos, products or service names, trademarks, service marks, trade dress, other indicia of ownership, or copyrights.

“MyTrip Products” means MyTrip Provided Services and Third Party Services.

“MyTrip Provided Services” include, but are not limited to, the provision of services in the field of transportation (including MyTrip Transportation Services).

“MyTrip Transportation Service” means the provision of the passenger journey which is the subject of a booking accepted by MyTrip as set out in these Terms.

1. Overview

1.1 These terms cover your access to and use of MyTrip's App(s)/Website(s) Services and your use of MyTrip Products (the “Terms”).

1.2 You must read carefully and agree to the Terms prior to accessing and using MyTrip's App(s)/Website(s) Services and MyTrip Products. These Terms expressly supersede prior agreements or arrangements about the App(s)/Website(s) Services and MyTrip Products between you and MyTrip or MyTrip Affinity.

1.3 These Terms apply to the extent they do not conflict with any user and supplemental terms that specifically apply to MyTrip's App(s)/Website(s) Services and MyTrip Products. You will be asked to agree to any such terms separately.

1.4 By using MyTrip's App(s)/Website(s) Services, you confirm you accept these Terms. If you do not agree to these Terms, you may not access or use MyTrip's App(s)/Website(s) Services. We recommend that you keep a copy of these terms for future reference.

1.5 If we have to contact you, we will do so by push notification from MyTrip's mobile application, phone call, text message or email, using the details you provided to us on registration. When we use the words “writing” or “written” in these terms, this includes emails, texts and push notifications.

2. MyTrip Provided Services

2.1 The specific terms governing MyTrip Provided Services, other than MyTrip Transportation Services, may be set out in additional terms or a separate agreement.

2.2 MyTrip is free to decide to accept or reject a request. Acceptance is communicated to you through MyTrip's mobile applications and/or websites, and the related terms or agreement will set out when a direct contract forms between you and MyTrip.

3. Third Party Services

3.1 For Third Party Services, MyTrip acts as a disclosed agent between you and the Third Party Providers to enable them to provide the Third Party Services to you. MyTrip does not provide Third Party Services. All Third Party Providers are independent third party contractors, registered businesses or other legal entities who are not employed by or acting on behalf of MyTrip.

3.2 When you are logged in, online and in the service area of a Third Party Provider, you will be given information about the Third Party Services before you decide to make a request.

3.3 Third Party Providers are free to decide to accept, reject or ignore a request. Acceptance is communicated to you and will give rise to a direct contract between you and the Third Party Provider.

3.4 You may be asked to rate the Third Party Provider whose services you requested. The Third Party Provider may also be able to give you a rating.

3.5 The Third Party Provider is responsible for any obligations that may arise from the provision of the Third Party Services.

4. Privacy Notice

4.1 MyTrip collects, uses and discloses information from or about you as described in MyTrip's privacy notice. Additional privacy notices may apply, including from third party controllers, for MyTrip Provided Services or Third Party Services. We will notify you when such notices apply to you.

5. Charges and Payment

5.1 Charges for MyTrip Provided Services and Third Party Services. If you make a request, you agree to pay the relevant charges as described in MyTrip's mobile applications and/or websites and will be responsible for any charges or fees linked to your account. Charges may be displayed before a request is placed, or may depend on your use of the services; we may provide an estimate, and the final amount charged may differ from the estimate. You may be charged supplementary charges, costs and/or fines for your use or misuse of the services (such as repair or cleaning fees). Once a service has been provided, we may issue an invoice from MyTrip or on behalf of the Third Party Provider, including VAT (PPN) where applicable.

5.2 For more information about charges and supplementary charges, fees, costs and/or fines, please consult the support section in MyTrip's mobile applications and/or websites.

5.3 The charges may be modified from time to time.

5.4 The charges do not include tips. Where available, you may pay tips either in person or through the app; we will collect tips paid through the app on your behalf and remit them.

5.5 Unless otherwise agreed, all charges are due immediately upon a request being placed, and payment will be facilitated using the preferred payment method associated with your account, after which MyTrip will send you a receipt by email.

5.6 Charges are inclusive of applicable taxes including VAT (PPN) unless specifically stated otherwise.

5.8 Cash Payments. MyTrip may enable you to select “cash” as a payment method. If you select cash, you will not be able to change the destination of your trip or add stops without changing the payment method or cancelling. If you do not have exact change, MyTrip may suspend access until payment is received, and will issue MyTrip credits for any overpayment.

6. Cancellation

6.1 In some cases you do not have the right to cancel a request once accepted. For certain services, MyTrip or the Third Party Service Provider may allow you to cancel, but you may be charged a cancellation fee.

6.2 MyTrip may refuse requests and cancel services if there is reasonable doubt about the correctness or authenticity of the request or the contact information. A cancellation fee may be charged.

6.3 Look up the cancellation policy in the MyTrip App.

7. Termination

7.1 You are free at all times to use the App(s)/Website(s) Services (where and when available) and may terminate these Terms by closing your account.

7.2 We may terminate these Terms and your access with immediate effect if we conclude that there is a breach by you of these Terms or any other agreement between you and MyTrip.

7.3 MyTrip may, in its sole discretion, terminate these Terms or discontinue the App(s)/Website(s) Services at any time by giving you reasonable advance notice in writing.

7.4 If we cannot charge the relevant charges to your preferred payment method, we may suspend or remove your access until payment is made.

7.5 You must immediately pay any outstanding charges due to Third Party Providers or MyTrip upon termination. Such charges will survive termination.

8. Your Liability and Indemnity

8.1 You are liable for any damage suffered by us as a result of your violation of these Terms, your misuse of the services, or your violation of any laws or third party rights. You are liable for all activities conducted through your account unless such activities are not authorised by you and you are not otherwise negligent.

8.2 You agree to indemnify, defend (at our option) and hold us and our respective officers, directors, and employees harmless from and against all claims, liabilities, expenses, damages, penalties, fines, social security contributions and taxes arising out of or related to a breach of these Terms, breach of applicable law, or third party claims directly or indirectly related to your use of the services.

9. Limitation of Liability

9.1 Nothing in these Terms limits or excludes any liability which cannot legally be limited or excluded, including liability for death or personal injury caused by negligence and liability for fraud or fraudulent misrepresentation, or alters your rights as a consumer that cannot be excluded under applicable law.

9.2 MyTrip, its affiliates, directors, officers, employees, workers, agents and/or subcontractors are not liable for: (i) loss of profits; (ii) loss of sales or business; (iii) loss of agreements or contracts; (iv) loss of anticipated savings; (v) loss of use or corruption of software, data or information; (vi) loss of or damage to goodwill; and (vii) indirect or consequential loss.

9.3 MyTrip and the parties above are not liable for: any Booking not accepted or otherwise cancelled by MyTrip; damages or losses arising from any transaction between you and a Third Party Provider; the availability and accuracy of the content, products or services of the Third Party Provider; or delay or failure in performance resulting from causes beyond our reasonable control.

9.5 MyTrip is not liable for business losses. App(s)/Website(s) Services are provided only for private use.

10. General

10.1 MyTrip may change these Terms from time to time. We will inform you of changes within a reasonable time period. You will be bound by such changes upon their notification to you. If you do not agree with these changes, you are free to close your account in accordance with Section 7.1.

10.2 The invalidity of any provisions in these Terms does not affect the validity and enforceability of the rest of these Terms. Any invalid, illegal or unenforceable provisions shall be deemed deleted.

10.3 We may assign, subcontract or transfer these Terms or any of our rights or obligations, in whole or in part, without your prior consent, provided this will not lead to a reduction of your rights. You may not assign, subcontract or transfer these Terms as your use is personal, unless agreed otherwise.

10.4 These Terms replace all previous agreements relating to your access and use of the App(s)/Website(s) Services.

10.5 You may be required to accept additional terms to access or use the App(s)/Website(s) Services, MyTrip Insurance Services and/or MyTrip Products.

11. Dispute Resolution Process

11.1 In the event of a dispute, we would ask you to raise a complaint using the contact details in the “About Us” section above. If we cannot resolve the dispute, we will work with you to discuss a way forward, which may include mediation. MyTrip's right to refer the dispute to a court is expressly reserved.

12. Governing Law and Jurisdiction

12.1 These Terms shall be exclusively governed by and construed in accordance with the laws of Indonesia.

13. Acceptance

13.1 By accessing and using the App(s)/Website(s) Services in another country, your access and use may be subject to country-specific terms.

13.2 MyTrip's mobile applications and/or websites may be made available to you under various branding depending on the MyTrip Product(s) you are accessing or using at the time.

14. Your Access to and Use of the Services

14.1 MyTrip's mobile applications and/or websites can be downloaded or accessed on most modern mobile devices with an internet connection running Android or iOS.

14.2 You are responsible for obtaining the network access necessary to use the services and for any rates and fees from your mobile network provider, and for obtaining compatible devices and operating systems, including any software or hardware updates.

14.3 We provide the services “as is” and “as available.” The services may be subject to limitations, delays, and other problems inherent to the use of the internet and electronic communications. MyTrip may suspend, withdraw or restrict availability for business and operational reasons and will try to give you reasonable notice.

14.4 To register and set up an account you must be eighteen (18) or older. The terms governing specific MyTrip Provided Services or Third Party Services may impose different age requirements.

14.5 You must provide certain personal information to register, including your phone number and email address, and may need to provide at least one valid payment method and additional information for certain services.

14.7 MyTrip may temporarily restrict your access if there is a suspected breach of your obligations or otherwise of these Terms, including where we receive a complaint in relation to fraud.

15. Your Obligations When Using the Services

15.1 When using the services, you must comply with all applicable laws. You may only use the services for lawful purposes and for their intended purposes, and must not misuse the applications or attempt to defraud us or Third Party Providers.

15.2 You must provide accurate and complete information when you register and when using the services.

15.3 Your account is personal to you and cannot be licensed or shared unless expressly permitted by MyTrip. You may not register more than one account (unless agreed in writing), allow third parties to use or transfer your account, and must keep your login details safe and confidential, telling us immediately if you suspect unauthorised use.

15.5 You must not cause any nuisance, annoyance, inconvenience, or property damage in your use of the services.

16. Problems With Your Services

16.1 If there is a problem with the services, or if you have a complaint, please contact us using the details set out in the “About Us” section above.

17. Reliance on Information

17.1 Although MyTrip makes reasonable efforts to update the information provided, MyTrip makes no representations, warranties or guarantees that the content on the applications and/or websites is accurate, complete or up to date.

18. Ownership of and Rights in the Services

18.1 MyTrip reserves all rights not expressly granted in these Terms. The services, MyTrip's devices and all data gathered through the applications and/or websites (including all intellectual property rights) are and remain the property of MyTrip or its licensors.

18.2 You may not (and may not allow any other party to) license, copy, modify, distribute, sell or lease any part of the applications; reverse engineer or extract source code except as allowed by law; scrape, index or data-mine any part of the applications or data; or misuse MyTrip Names, Marks, or Works.

18.3 Subject to your compliance with these Terms, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable, non-sublicensable licence to install and use MyTrip's applications and/or websites on your device solely for your use.

19. Service Provider and Private Hire Vehicle Operators

19.1 For MyTrip Transportation Services within Indonesia, you will be contracting with the MyTrip entity which has accepted your booking as the relevant licensed private hire operator.

19.2 Pursuant to the Legislation, a booking request made by you can only be accepted by a person that holds a private hire operator's or booking office licence.

20. MyTrip Contract With You for Transportation Services

20.1 A request for a Booking constitutes an offer by you to purchase MyTrip Transportation Services in accordance with these Terms. Your offer shall only be accepted when MyTrip issues written confirmation via text message, email or push notification, at which point a contract (“Contract”) comes into existence. There is no obligation on us to accept a Booking. If a driver becomes unavailable after confirmation, we will endeavour to find another driver; where none can be found, we reserve the right to terminate the Contract without compensation to you.

20.3 We will inform you of the estimated time of driver arrival and journey completion, but these are estimates only and time shall not be of the essence.

20.4 The price for the Contract (including VAT (PPN), if applicable) will be provided before you place your Booking request and may include relevant surcharges and tolls. You may be charged a different amount in certain situations, including material changes to pick-up/drop-off point, route, waiting time, stops or traffic.

20.9 Your right to cancel a Contract depends on when you decide to end it. If MyTrip is not at fault and you do not have a right to change your mind, you may still end your Contract but may be charged a cancellation fee.

20.11 MyTrip also provides certain booking services, including accepting Bookings, keeping records of Bookings, remotely monitoring transportation services booked using the MyTrip app, dealing with feedback and complaints, and managing lost property queries (the “Booking Services”).

21. Problems With Your Transportation Services

21.1 If there is a problem with MyTrip Transportation Services, or if you have a complaint, please contact us using the details set out in the “About Us” section above.

21.2 All private hire vehicles are required by law to hold and maintain PHV insurance. If your problem relates to a motor incident, please contact us for your driver's insurance details.

21.5 MyTrip does not exclude or limit its liability in any way where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or that of our employees, workers, agents or subcontractors, or for fraud or fraudulent misrepresentation.
